The company AKOME PARIS (as defined in Article 1 below), engaged in the sale of high-end ready-to-wear clothing and accessories on the site **www.akomeparis** (the “Site”), on its mobile applications for iOS and Android, as well as in its physical stores.

To offer for sale, sell, and deliver its products, AKOME PARIS collects personal data (the “Data”) from users of its sites, mobile applications, and customers during purchases made in physical stores (collectively referred to as the “Users”).

This privacy policy aims to inform Users of the means implemented to collect, consult, process, and retain the personal data of Users.

AKOME PARIS, as the data controller, is committed to respecting the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, concerning the protection of individuals with regard to the processing of personal data and the free movement of such data, and of the French law No. 78-17 of January 6, 1978, as amended (known as the “Data Protection Act”).

The User is informed that certain Data must be collected by AKOME PARIS in order to provide its products and services. If the User does not wish to provide this data, AKOME PARIS will not be able to fulfill its services.

This privacy policy (“Policy”) may be modified at any time by AKOME PARIS, particularly to comply with any regulatory, jurisprudential, editorial, or technical changes. The User should refer to the latest version of the Policy before any navigation.

  1. The Data Controller

The data controller, who collects the personal data and implements the processing of Data, is;

For the purposes of this Policy, the terms “Process” or “Processing” refer to any operation or set of operations performed on the Data, such as collection, recording, organization, structuring, storage, adaptation or modification, retrieval, consultation, use, restriction, erasure, or destruction.

The term “Data” refers to any information relating to a User, identified or identifiable, particularly by reference to an identifier, such as a name, identification number, location data, or one or more specific elements unique to them.

  1. Collection of Personal Data

AKOME PARIS is required to collect Users' personal Data on the Site www.akomeparis.com, on its mobile applications for iOS and Android, as well as during purchases or events organized at AKOME PARIS.

The Data that may be collected includes the following:

- User Account Data: that is, the data that the User provides when creating an account by filling out the registration form (first name, last name, billing and shipping addresses, email address, mobile phone number, password for logging into the customer account);

- User Personal Data when entered in their customer account: date of birth, clothing and shoe sizes;

- Transaction Data: refers to the User's information related to orders placed and returns, such as their phone number, address, email address, and information regarding their payment method;

- Exchanges with Customer Service;

- Browsing Data: refers to the data collected by the Publisher during the User's navigation on the Sites and Applications, such as the date, time of connection and/or navigation, browser type, browser language, IP address, location data, and geolocation;

- Personal Data of Contest Participants: when you participate in a contest on our social media, we may retain the personal data of the winners.

Payment data (credit card number, expiration date, authorization number, security code) is collected directly by our payment service providers. AKOME PARIS never has access to its customers' payment data.

Third-party application providers linking to our Site and/or mobile applications, as well as the networks on which we publish content (such as Facebook, Instagram, and LinkedIn), may also use automated tools to collect data from Users (profiling of online activity). This data collection is conducted directly by these providers and/or third parties and is subject to their policies. To the extent permitted by applicable law, AKOME PARIS is not responsible for the practices of these providers and third parties.

Certain services may be altered or inaccessible without consent to the collection of the Data mentioned in this Privacy Policy.

Some personal Data collected across various platforms (Sites, mobile applications, social networks) may be combined.

  1. Purposes of Collecting Personal Data

The Data collected through the use of the Sites, applications, or in physical stores is subject to Processing to meet the purposes described in the table below.

The current regulations protect Users' privacy and require every data controller to justify a legitimate basis for such Processing. The regulations thus provide among the legal bases for Processing:

- The performance of a contract to which the data subject is a party, such as a sales contract. Therefore, certain personal data of the User is necessary to deliver the product, manage the customer account, and process returns;

- Compliance with a legal obligation, notably accounting through the retention of invoices;

- The prior consent of the data subject;

- The legitimate interest of the data controller, in compliance with the rights and freedoms of Users. Thus, improving customer experience or preventing fraud may justify Data collection.

AKOME PARIS does not share any personal Data for commercial purposes with third parties.

The User has the option to modify their personal Data and withdraw their consent at any time by logging into their customer account.

  1. Service Providers with Access to Users' Personal Data

The personal Data collected are transmitted to AKOME PARIS's service providers, who may carry out Processing on behalf of AKOME PARIS (subcontractors) and/or for their own account (data recipients). The recipients of the data are:

- Payment service providers;

- Any police or administrative authority in the context of judicial requisitions concerning the fight against fraud;

- Customs services and providers in the case of deliveries abroad.

The subcontractors of AKOME PARIS may have access to the collected Data for:

- The preparation and shipment of orders and the return of products;

- The improvement of the content of the Sites and mobile applications;

AKOME PARIS may also share the Data of Users who have a customer account in its physical stores. Their access is limited to the orders placed by the customer.

  1. User Rights Regarding Their Personal Data

In accordance with Articles 14 to 22 of the General Data Protection Regulation (GDPR) 2016/679 of April 27, 2016, any individual using the site or mobile applications has the ability to exercise the following rights:

- A right of access, rectification, and deletion of the collected data;

- A right to object to the Processing of their data;

- A right to restrict Processing;

- A right to data portability;

- The right to issue directives regarding the retention, deletion, and communication of their personal data after their death in accordance with Article 40-1 of the Data Protection Act.

Finally, if AKOME PARIS detects a data breach that could pose a high risk to the rights and freedoms of its Users, it commits to informing the affected users as soon as possible and the competent supervisory authority, namely, for France, the CNIL.

The User can exercise all of these rights by logging into their client area, contacting customer service at contact@akomeparis.com, or by regular mail to AKOME PARIS – Customer Service, 7 rue Tisserant, 92100 Boulogne Billancourt, France.

The user must attach proof of identity to their request.

  1. Transfer of Personal Data Outside the European Union

This Data may also be transferred to AKOME PARIS's service providers, allowing it to provide its services to its Clients (including carriers, hosts, and technical service providers to manage the websites). This transfer occurs under the standard contractual clauses of the European Commission.

  1. Data Retention Period

Users' Data will not be retained beyond the duration strictly necessary for the purposes pursued as stated herein and in accordance with applicable regulations and laws. In this regard, Data used for prospecting purposes may be retained for a maximum period of 3 years from the closure of the User's account or the last contact with the concerned prospect. The User's data are deleted when the retention periods expire.

However, certain Data may be archived beyond the stipulated periods for research purposes, as well as the establishment and prosecution of criminal offenses, solely to allow, as needed, the provision of this data to judicial authorities.

Archiving means that this Data will be anonymized and will no longer be accessible online.

  1. Security Measures for Collected Personal Data

As the Data Controller, AKOME PARIS commits to take all necessary precautions to preserve the security and confidentiality of the data and, in particular, to prevent them from being altered, distorted, or accessed by unauthorized third parties.

AKOME PARIS has entered into service contracts with partners who have proven expertise in the field of data protection.

All Data is hosted in France or within the European Union.

Payment Service Providers

Payment for purchases on the Site and the mobile application is made either via PayPal or Visa/MasterCard credit cards.

PayPal (Europe) S.a r.l. et Cie is a Luxembourg-based limited partnership, registered with the R.C.S. of Luxembourg under number B118349, whose registered office is located at 22-24, Boulevard Royal – L-2449 Luxembourg. AKOME PARIS never has access to clients' payment data.

The User can choose to save their payment card data in their customer account.

This data is not stored by AKOME PARIS but by PayPal. The User can modify or delete this banking data at any time by logging into their customer account.

When navigating on our website and mobile applications, information related to the user's navigation on their terminal (computer, tablet, smartphone, etc.) may be recorded through files called "Cookies."

Cookies allow for tracking navigation or analyzing User behavior, including:

These cookies are necessary for the proper functioning of our website and must remain active if the User wishes to access all services provided by the website.

AKOME PARIS is in no way responsible for any damages caused by third parties due to or arising from Users' publication of their personal data.

AKOME PARIS is not responsible for the Processing of personal data by these third-party sites. The User should consult their personal data protection policies.
